Brisbane Radiology Pty Ltd ACN 654 059 668 is the main service company operating under Brilliant Medical Pty Ltd. 

We are obliged to protect the privacy, security and confidentiality of personal information and make clear the ways in which we deal with personal information. Depending upon the circumstances, these may include the Australian Privacy Principles (‘APPs’) in the Privacy Act 1988 (the Privacy Act) and laws relating to the protection of health records. 

Personal Information Details 

Of Patients 

In order to provide a health care service, it is necessary that we collect and use patient information.  Inaccurate or incomplete information provided to us may result in our inability to provide our services as requested. Information collected by us includes, but is not limited to current and historical information about; 

  •  Name 
  • Gender 
  • Date of birth 
  • Contact details including phone number, email address, home address 
  • Emergency and next of kin 
  • Billing and payment details including credit card, banking, concession card, Veterans’  Affairs, pension and Medicare numbers and details 
  • Private health fund, Workcover, employment and accident details 
  • Healthcare identifiers 
  • Medical history 
  • Radiological history 
  • Family medical history 
  • Communication and interactions with our team 
  • Relevant feedback, complaints and claims 
  • Requesting practitioner details

Of Prospective, Current & Past Employees, Contractors and Service Providers 

We may collect the following information;

  • Qualifications, skills, experience, external prior employer and character references.
  • Application letters and resume.
  • Pre-employment checks including but not limited to; health, reference, directorship,  financial probity, eligibility to work, criminal records and vocational suitability checks. 
  • Performance, conduct, use of our IT, systems and communications resources, payroll information and training. 

Of Other Health Care Provider Information 

We may collect the following information;

  • Healthcare provider number 
  • Referral trends 
  • Area of specialty 
  • IT, systems and communication access, requirements and related details

  • Preferences for the current and future provision of health services.

Personal Information Sources 

Personal information is often collected directly from you,via details provided to us, either; on a health  service request form, over the phone or online at the time of booking, confirming your appointment via written and verbal correspondence, when completing questionnaires, consent forms, before ,during or after your health service provision, at the time of billing for a service. 

Occasionally, personal information may be collected about a patient from a third party source such as;

  • Relatives, next of kin, personal representatives. 
  • General practitioners, medical specialists, pathology or other radiology providers. 
  • Allied health providers such as physiotherapists, chiropractors, osteopaths, podiatrists,  dentists, nurses. 
  • Hospitals, screening and day surgery units. 
  • Your Australian Government “My Health Record” if you are participating, and have permitted us to access the record. 

If a person’s health is potentially at risk, we may need to disclose or obtain personal information to or from a third party without the person’s consent to facilitate emergency medical treatment

Use & Disclosure of Personal Information 

Providing a quality health care service requires the collection, use and disclosure of your personal  information to; 

  • Provide a health service including diagnostic imaging or a therapeutic service. 
  • Assess your health status. 
  • Comply with legal or regulatory obligations. 
  • Provide a medical report about your health. 
  • Manage our practice – including sending out appointment reminders. 
  • Collaborate and communicate with other health care providers connected with your  medical care. Examples include; medical practitioners, nurses, allied health professionals,  pathology services, physiotherapists, outpatients and community health services. 
  • Provide advice and information in relation to how the diagnostic imaging services and  associated therapeutic services will be or has been provided. 
  • Recover monies, billing purposes and account keeping.  
  • Ensure patient medical records are correctly linked with relevant healthcare professionals and services such as Medicare, Defence, Department of Veterans Affairs, Insurance Commission of Western Australia, Private Health Funds.
  • Contribute radiology reports to your Australian Government “My Health Record”.  
  • Produce records to courts, Medicare, Department of Health and Aging.  
  • Manage our relationship with you including to contact you for follow up purposes, respond  to your queries via telephone, online or by post, and send you correspondence in relation to services performed by us (for example, reminding patients of an appointment). 
  • Verify and update personal information held by us. 
  • Administer quality assurance, practice accreditation and complaint handling.  
  • Undertake market research, review referral patterns and perform statistical analysis. 
  • Customise services and provide educational resources.  
  • Recruit personnel. 

We participates in research from time to time and will only use or disclose your personal information for research if you have given consent to participate (or, in limited cases, where the  requirement to obtain consent requirement has been waived by a Human Research Ethics Committee) and the research has been approved by a Human Research Ethics Committee. 

And for other purposes required or authorised by or under law, including those purposes for which you have provided your express or implied consent. We may provide personal information to: 

  • Guardians and Parents (for patients under 18 years of age). 
  • Enduring Power of Attorney. 
  • Insurers including private health funds .
  • Government agencies (Medicare, Department Veterans’ Affairs, WorkCover, Health  Departments).

  • Australian Commission on Safety and Quality in Healthcare and patient  ombudsman  services.
  • Our service providers, including but not limited to; auditing, accounting, legal, debt collection, data processing, data analysis, research, investigation, insurance, and technology services. 

Storing & Retaining Personal Information 

We store and retain personal information using our own secure systems or with the assistance of  our service providers and partners. We store our records within Australia and do not ordinarily transfer identifiable information outside of Australia. 

To the extent required by the Privacy Act, we take reasonable measures to ensure that your personal  information is protected from misuse, interference, loss and from unauthorised access,  modification, and disclosure. 

Unless we are required to retain your personal information in accordance with legislative and  regulatory requirements, we will take reasonable steps to destroy and/or de-identify your personal  information in a secure manner once it is no longer necessary to hold the information for the provision of services to you. 

Personal information may be held in the following formats: 

  • Hardcopy documents located securely onsite or in secure storage facilities.  
  • Electronically in a secure environment and format.
  • Digital audio recordings. 
  • Digital cine-loops. 
  • Digital or hard copy of images.

If you use our website to read, browse or download information, our system may record information such as the date and time of your interaction, the pages accessed and any information downloaded. This information is used for statistical reporting,website administration and maintenance purposes.

Access & Changes to Personal Information 

You are entitled to access your own records or the records of another person where you are  authorised to make a request on their behalf. For example: you are the person’s legal guardian 

You are entitled to access your own patient health records that we hold. This can be done either  through the government’s My Health Record database or our information system. Applications for  access to your information can be made via hello@brisbaneradiology.au 

We might deny you access to your records if: 

  • We reasonably believe that to provide access would create a serious threat to life or health. 
  • There is a legal impediment to access. 
  • The access would unreasonably impact on the privacy of another person 
  • The information relates to anticipated or actual legal proceedings, and you would not be entitled to access the information in those proceedings. 

 

We will not charge an application fee but may impose reasonable charges for elements such as  administration, photocopying and delivery. We will also request confirmation of identity before releasing information which may include photographic identification. 

Ancillary Activities 

Delivery of Imaging Data Electronically 

We use secure internet based technology to deliver images and reports. All of these transfers are logged. 

Delivery of Results & Samples 

Occasionally imaging and reports are delivered by our own staff, commercial couriers, taxis or registered post. If this is unacceptable to you, please arrange with our staff to collect your own results.  

Pathology specimens are delivered by our own staff, commercial couriers or are collected by the analysing pathology laboratory. 

Maintenance Personnel 

For operational purposes, it is necessary to allow maintenance personnel access to our premises. However, only authorised personnel are allowed access to personal records. 

Contact Details 

If we need to contact you for any reason and need to leave you a message, it may be necessary for us to say where we are calling from. Please advise our reception staff immediately if you do not want us to do this. We may then need to arrange alternate contact details.

Security 

We use video surveillance or “CCTV” devices. Images and video captured through these devices  must be handled with respect to the APPs, the Act and the Surveillance Devices Act 1998 (WA). For  example, this means that we will ensure that;  

  • CCTV is only used in public areas of the premises and not in areas where persons would have an expectation of privacy, such as a change room or bathroom.  
  • Signage displays information about the operation of CCTV or other surveillance device in the area 
  • Any recorded personal information is kept secure and destroyed when no longer needed. 

Consent  

Parent(s) or legal guardians are required to provide consent for the provision of services for young people under the age of 16 or any other persons incapable of providing consent. 

Where a patient does not have capacity to give consent for themselves, information about the service (including personal information of the patient where necessary) must be provided to the patient’s legal guardian, so that they are in a position to provide informed consent.
